NEW: NSA deleted large volume of data from Bush-ordered Web surveillance, despite court order and promise to preserve it. Spy agency 'sincerely regrets its failure'http://politi.co/2FYcxym

Just how 3rd-rate & amateurish is NSA's IT staff? Deleted backups subject to a court preservation order. Have they no clue? Yes, a rhetorical question.

"Backup" probably doesn't mean to them what u think. Data is widely sharded. The same bits are in 50 different systems in different buildings, then assembled as required. Redundant & fault tolerant like nrml backup, but w/o a disk you can go to and say "there's the backup file!"

@emptywheel 1. Could be, but I'm skeptical. First & foremost, one would have to understand that NSA was under specific Federal court order to maintain intercepted Internet data. NSA General Counsel's office would've made it clear to NSA IT tech.

2, Secondly, after NSA GC explains court order, NSA IT Techs' duty was to explicitly provide the data to the NSA GC's office. So somebody in NSA IT royally screed the pooch by only giving NSA GC the metadata.

Intentional. This is not the first time they deleted knowingly illegal data.

That's putting it bluntly! I'd agree that incompetence would be a really hard sell.

Sure, but I'm serious. This is at least the third time they've done this.

And they keep doing it because no one goes to jail. Put a few people in a federal facility for contempt or perverting the course of justice and watch things start to change. Loyalty only goes so far. Liddy and Haldemann found that out the hard way.

I don't know all the nuances of US Federal judiciary history regarding real penalties, but regardless of that, it sure is the case that too often those responsible in the Executive branch are never held accountable.

Their processes are not designed for law enforcement. They tend to be good at what they do, but what they do is gather intel, and other activities are given low priority.

Even assuming not designed for LE, I can't really believe that NSA IT doesn't understand their own databases & data storage. It simply doesn't pass the smell test of even a nominally competent IT organization.
