I feel like a lot of responses to this piece by @jacklgoldsmith & @Susan_Hennessey are missing this graf https://lawfareblog.com/merits-supporting-702-reauthorization-despite-worries-about-trump-and-rule-law …pic.twitter.com/aQmf2DX1fv

Not me. I wrote an entire post abt how stupid such claims are given that FBI IS part of the IC, and that this program uses the FBI as a means to launder from IC to LE. There was just so much else that was evidence of the opposite of what it claimed I didn't return to that.

The program does not use the FBI to launder from IC to LE. It has a mechanism to allow agents/analysts to do something if they happen to see evidence of a serious crime (other than terrorism). It doesn't come up much, but is really just common sense.

Like you just described. Laundering info from IC to LE. 1) Is FBI IC? Yes. 2) Is this data used in both an intel and LE function at FBI? Yes. Next question?

Is it, or is it not, the case that people (and I've got a number of people in mind) who got prosecuted off stuff that came in largely for an Intel function? In at least two cases, erroneously, I'll add.

I understand--bc I was the first to report--on the full investigation intake. But that doesn't protect against related information being used in ways that are problematic.

It's the "launder" term to which I take exception. That suggests 702 is being used to get around the warrant requirement and that is absolutely not the case.

Which one? The one on Tor nodes? The one on comms for which a significant purpose is FI? The ones for accessing the comms of people about whom FBI has no evidence of wrongdoing? Bc yes, it is used for that purpose, which is the complaint.

For this *particular* use, I'm happy to use "parallel construction," if you prefer.
