1. Too late. It has been used by people in this way for years. 2. True, but totally separate from use of pre-existing connotation. 3. True, and civil libertarians have made pains to do that all year.
All that said, I have the same concerns about Whataboutism, which has a prior meaning but as used can't be divorced from Jim Crow era efforts to downplay Russian efforts to raise US civil rights concerns to distract fr own persecution of dissidents.
