        Moreover, you CANNOT endorse expansive Insider Threat detection programs without being okay with texts like these being access by an IG. That's the entire point of Insider Threat detection.

        Do you have a cite for the fact this was on FBI devices? I don't doubt it since presumably that's what the IG requested, but I also haven't seen it actually confirmed anywhere and it's so weird they wouldn't be using personal cells for this kind of thing.

        Thanks, that's the letter I'd seen referenced but couldn't find. So weird to use USG device like this, but maybe related to wanting to conceal communications from a spouse.

        I don't think it's possible to text from the high-side/classified enabled devices (just email), but this could apply to thinking they'd be withheld as LE sensitive or similar.

        Honestly, I'm so confused not sure what conclusions to draw (also FBI practice with the phones could be different from agencies I'm familiar with). I do think (1) scandal element is pure nonsense and (2) these people showed astoundingly bad judgment.

        Absolutely agree on 2. I'm sympathetic to those who say we can't decide whether there is a scandal until we understand "insurance" comment. And until we see Trump investigation era ones. We don't know yet. Nor does Horowitz or we'd have a report.

        We can't lose sight of the fact that the Trump campaign was in touch with Russia, and two have already been indicted, regardless of the FBI agents.

        Two have pled guilty and two indicted. But Mueller may be proceeding in such a way as to avoid any poison fruit, thus the reliance on plea deals for false statements.

        For CI purposes they'd still be easy for FBI to obtain. Again, these people are subject to Insider Threat monitoring. That's everything. For better and worse.

        As a federal employment lawyer, I disagree. They are still individually-identifiable records under government control. I have had several cases involving the Privacy Act and I assure you they are covered under it. Not sure where you are getting this.
