That's in context of clearances exclusively, right? It almost seemed like it was going to be litigated in the al-Haramain case, over whether NDCA could order govt to share stuff w/plaintiffs.

You mean Constitutional right of court to order sharing of classified info?

NDCA had the Stellar Wind log showing al-Haramain targeted w/CSO (so in their possession). Q was whether plaintiffs' lawyers could see it. Govt argued no need to know. Walker found other way to do it, but there was moment it seemed he'd say it was his discretion.
