Realistically though, as often as not, domestic users end up connecting to servers overseas on the initial and/or subsequent hops prior to the end site. Wouldn't that fall into the current legality of spying on any domestic connections with overseas endpoints?

My guess is they collect upstream just off domestic nodes, meaning if your exit node is in the US, they'll get it. But then, they're prolly getting exit nodes in the rest of the world, too.
