Yes, which raises the question how Flynn could be prosecuted for this when in his defense he would presumably raise above TS USG violations of multitudinous allies' sovereignties. Will Mueller think: better left alone?
It depends on whether Mueller can show Flynn was going to profit personally.

I assumed Flynn may be legally prosecuted under all elements of the crime; was addressing (poorly) whether Mueller will exercise discretion not to file, BC Flynn would likely argue that US must reveal state secrets necessary to his defense, so he can't get a fair trial otherwise.
