Note they have not charged him with Tax Evasion, a crime. The moving of money around that was not gained illegally, is not a crime. What I have seen in the indictment does not seem to allege illegal gotten gains or tax evasion. Unless there is amended indictment I have not seen.

Note you're expecting the indictment to be literal. And also not factoring in the ways Mueller is pardon-proofing this.
