If TAO was ahead of Kaspersky's detection signatures, detection was not possible. So yes, it wasn't malware FOR Kaspersky but otherwise yes

One thing to ascertain in code review is that ”threat detection rules” are only way to retrieve files, and they can’t be customized to specific customers. Then review of said rules can ascertain whether product is (currently) being used for purposes other than advertised.
