It's not clear that the code Hutchins admitted to writing did that. Evidence suggests the contrary.

Has anybody done any analysis to see whether the code he posted on his blog was the same as in Kronos, btw?

Yes. Not written up yet but as I understand it Kronos code doesn't support claim made in indictment but not in reported confession.

Even by DOJ's own public statements the malware pre-existed Hutchins' charged actions.

Um. What are you talking about there is no public evidence? If there's no malware there's no case. Of course there is public evidence.
