The indictment alleges Hutchins authored Kronos, period. This "confession" says he authored code in it.

Because code in Kronos =/= Kronos.

Sure. And the moving goalposts of this "confession" raise real questions whether that happened.
Moreover, selling malware is NOT illegal (and not what alleged). Selling a wiretapping device for purpose of wiretapping is.
