Of course not. But if the prosecutor is using them as evidence, his lawyer is going to have to discredit them.
Huh. I thought the Constitution had it, "innocent until proven guilty," not "lawyers have to disprove evidence against clients"?
I'm making the assumption that the prosecutor is going to have something to back up its provenance.
