      The kill switch seems like the best available mechanism, and it didn't require any hacking back.

      taking over the domain would be the hacking back. not registering it makes the argument over who "owns" it cleaner, still could be disputed

      No, registering an unregistered domain is not anything covered by the Graves bill, it is perfectly legal today.

      Not clear to me Graves bill would permit that, nor that it would be better to permit that by private party vs govt action.

      Not sure legislation is necessary to enable that. If so, it needs to include a requirement that it was infeasible to get owner cooperation.
