One thing that was never resolved in Valerie Plame leak case is whether Cheney could order Libby to share Plame's ID w/o Bush's permission.

But if Pence believes that EO language giving VP classification authority extends to declassification, he could leak at will w/o any risk.
-
And Trump can't even fire him (the only member of his team he can't fire...).
-
Bingo! He CAN change the EO. He could exclude him from anything interesting. But cannot fire him.
-
Change the EO, and then catch him for leaking classified information, then let congress impeach him...
-
And then make Ivanka his own VP. Tho doubt Congress would approve that.

Related? A law allows POTUS to delegate authority to officials *who've been confirmed by the Senate* – iow, not to VPOTUS.
-
Not related. Classification authority is granted to VP in existing classification EO & Exec maintains no law binds them.
-
Yes. But I was wondering as to your discussion of declassification.
-
Ah. Well, when I was asking these questions in 2007, no one knew the answer.

Maybe we should start calling him President Pence. See if Trump gets jealous and tries to fire him.
