this. didn't. happen. the IC can't surveil a US person without a FISA warrant. kind of shocking that @RandPaul is getting on this bandwagon.https://twitter.com/RandPaul/status/860480504168165378 …

that is nowhere near the allegation that Rand Paul is making, which is that the Obama admin ordered a "wiretapping" "ON" pres. candidates
-
Again, the Circa piece is about back door searches, and "wiretapping" is in quotes. The answer to Paul is prolly "no" but not an unfair Q.
-
oh, the "quotes" argument again. and here i was sure that defense had been mocked into oblivion.
-
Your practice is to not link through before you respond to a tweet?
-
Yes, Paul is being inflammatory. But yes, you are totally incorrect abt unmasking and back door searches.
-
Loose terminology leads to fuzzy concepts leads to *more* fake news. Want justice and accuracy both sides of aisle.
-
Great! Then journalists should not affirmatively misinform when they try to refute inflammatory language.
-
And so should you. Rand clearly was implying that warrantless "wiretapping" already targeted Trump, and "other" candidates.

If Paul was picked up talking to monitored foreigners that's a different story, and not illegal. + NSA would've had to approve any unmasking
-
No, NSA wouldn't have had to approve unmasking if it were a back door search, which (again) is what Paul linked to.
-
Some number of FBI Agents (by routine practice) would have had access to the Kislyak intercept contents once they searched on either one.

But isn’t the key distinction that they would need to be talking to a foreign person who was already being surveilled?
-
Sure. And also to be the subject of (at least) an assessment. But they surveil people who aren't "bad guys."

"Virtually certain" because you just assume IC always lie?
-
Virtually certain bc 1) we know FBI investigated Kislyak contacts 2) we think FBI investigated Flynn. Both would elicit searches on content.
