It's not. It's saying when firms say they're going to be responsive to reports of hate speech, they do so.

So it's delegating to third parties the decision of what constitutes hate speech. I can easily see that being abused :/.

Actually, it's asking private companies to fulfill their terms of service.

That's not mutually exclusive. Terms of services are light on specifics in order to give flexibility to the companies
