@emptywheel "Fair trial" means due process and jury of peers. Not sure why this particular criminal def. deserves special preconditions deal -
@Susan_Hennessey But due process when govt gets to use secrecy claims to limit args is suspect, even assuming fair CIPA. -
@emptywheel I don't necessarily disagree on substance. But strongly object to notion criminal def. gets to set special rules for himself. -
@Susan_Hennessey He--& others--have long said leakers can't get fair trial. Not just for himself. He just happens to have ability to say it.
