Jack Goldsmith Declares Victory … for Osama bin Laden http://www.emptywheel.net/2014/10/02/jack-goldsmith-declares-victory-for-osama-bin-laden/ …
@armandodkos One thing missing fr debate has been acknowledgment that, if ISIL use is unsound, so is AUMF use for targeting, etc.

@emptywheel Yes Goldsmith's reliance on 2002 AUMF is unsound IIf it doesnt fit under 2001 AUMF, then it doesnt work - for targetting or ISIL -
@armandodkos Not my point. EVERYONE agrees WH is playing loose w/AUMFs. That's a good sign it is doing so in secret, targeting people, too. -
@emptywheel Yes it is my point, that I believe holds for targetting and ISIL..200 AUMF was abt stoppling Saddam, not Al Qaida or terrorists -
@armandodkos right. But to extent 2001 is problematic, it also means most of the President's war powers are being waged problematically. -
@emptywheel Problematic is a nice word for it. Unconstitutional and illegal more accurate.
