Worrying HPSCI language could be read to allow comms providers to CREATE new records w/data they wouldn’t otherwise need to collect.
@normative Fairly clear that's true: but the permission for NSA "aid" (eg presence) may mean NSA (aka Booz) does it onsite.

@emptywheel Clear it could compel them to create “new records” in the sense of “we need the info in this format.” -
@normative Yup. But some guy at Booz named Edward will do it so no biggie.

@emptywheel Less clear it permits them to require those records to include data the provider wouldn’t otherwise need at all. -
@normative Ah, see your distinction. Think about how they might use it to get Internet "metadata." -
@emptywheel Exactly. Tons of “metadata” that flows through ISP pipes that they would never have any reason to (and generally don’t) record. -
@normative Also, did you see@EFF's point abt it using criminal law electronic communication definition? https://www.eff.org/deeplinks/2014/04/nsa-reform-bill-intelligence-community-written-intelligence-community-and … -
@emptywheel@EFF I made that very point several days earlier... http://justsecurity.org/2014/03/31/hood-hpsci-bulk-collection-bill/ … -
@normative Ah, I guess I needed to hanve the cloud stuff laid out bc I've been brainstorming how much they could get. Like packets?@EFF -
@emptywheel Not sure what you mean. Everything is in packets... -
@normative It's my malicious code question again. Can they get what they need to do cybersecurity searches, targeting on known code? - 3 more replies
