@granick Doesn't matter anyway. §702 procedures clearly permit spying on lawyers repping civil issues.

@granick Given that NYT was able to identify the probable firm, the protection doesn't offer any real protection here. -
@emptywheel Agreed. But USPERS comforted by minimization need to be clear that those "protections" not there under 12333. -
@granick Right. But even under §702 spying on those lawyers would comply w/NSA guidelines, wouldn't it? -
@emptywheel Yes. NSA only minimizes comms w indictees because of 6th Am. Anything the Constitution doesn't specifically forbid, they do. -
@granick NSA only treats as privileged indictee comms. They all get minimized, but so little that NYT can immediately ID the people.
