@emptywheel Is it at all clear what, if any, restrictions there are on LE who receive "crime" data swept up through 702 backdoor collection?

@DustinSlaughter Just minimization procedures. So if find a crime (or "threat to person which is property") then they can do what they want.

@emptywheel So LE can use that 702 crime data w/o judicial approval, in other words?

@DustinSlaughter Well, it's 702 collected. For HACKERS I'm sure they're going to parallel construct it, so we don't figure this out.

@emptywheel Simply meant (and plz correct if wrong) that LE can circumvent Title III with intaking data sucked up thru 702. Yes?

@DustinSlaughter Well, they can do that, if they have the right taps in place. Think they largely use it for leads.

@emptywheel Got it. I presume that would create all sorts of legal quandaries for lawyers during discovery...

@DustinSlaughter In terror cases they're going to be told it involves FISA (if they don't plea, as so many do), but that doesn't get far.

@emptywheel Right. Thinking i.e. narco. If "evidence" surfaces during backdoor collection and is passed to DEA. I get ur point tho.

@DustinSlaughter Well, intent was ALWAYS that if narco says, "go sell in LA," that'd get passed on. This is different.
