EITHER the dog-and-pony we've seen thus far on 215 dragnet is woefully incomplete or TS/SCI treatment of hearing is to protect lying.
@normative Yeah, as I pointed out here, they told the court it is still "in may respects" classified. http://www.emptywheel.net/2013/07/23/will-keith-alexander-finally-tell-the-truth-about-the-section-215-dragnet-in-todays-secret-emergency-hearing/ … Transparency™!

@emptywheel Probably lots of other circumstances where you want records that don't pertain directly to a named subject. -
@normative Like acetone! ;p If they got gun records, would they ALSO be unnamed? -
@emptywheel i.e. "intelligence indicates members of Group X have been purchasing Y type of weapon in the Z metro area over the past month" -
@normative But "intelligence indicates Inspire readers have used pressure cookers" should not get all pressure cooker purchases in US. -
@emptywheel Ideally that's the kind of thing you'd hope judges would do, though the FISC seems unwilling... -
@normative If terrorism trumps all then it's not clear how they would. -
@emptywheel Though legally, I think "no REP in pressure cooker sales receipts" is a lot easier to argue than "no REP in phone records" -
@normative Fair point. But doesn't that illustrate how dangerous divorcing this from proof that positive hits are meaningful?
