Well, that's odd. // Two Days Before Cambridge Cops Arrested Aaron Swartz, Secret Service Took Over the Investigation http://j.mp/UKJBux

@emptywheel What I do find odd is why they bothered w/ a state case at all. The S.A. handcuffed him, not Cambridge Police. Why?#n -
@PogoWasRight But yeah, state to SS is oddity. Also SS could have waited until Swartz HAD liberated journals, would have had stronger case. -
@emptywheel@PogoWasRight will probably have to get state docket in person--almost no MA court dockets are online. -
@BlakeA5@emptywheel No need to get the state docket. Aaron's lawyer informs me that the state never went further and dropped their case.#n -
@PogoWasRight Did he say precisely when that happened? Thta detail is actually pretty important. -
@emptywheel What I also find curious is why the feds waited until Feb. 9 to first apply for a warrant to search the laptop, drive, & USB#n -
@PogoWasRight You saw Swartz' team believed the computer was accessed in the interim? -
@emptywheel Yes. Despite the govt's posturing, I think the defense raised some really good points.#n

@emptywheel USSS investigates many cases where there's alleged theft or hack w/ significant $$ value, so I don't find that suspicious.#n -
@PogoWasRight Well, the $$ claim here is dubious. That's part of the issue: how do you value journals he could have gotten for free? -
@emptywheel That's an issue for USAO, but probably not for USSS, who may investigate based on claim that there's significant $$ value.#n
