Mohamed Mohamud is one of very few U.S. terrorists to go to trial. The question is "Can he be convicted in Portlandia?" http://nyti.ms/XYdcqy
@AllThingsHLS What is happening is they've just been selecting which parts of file--going back to when he was 16--they feel like revealing.

@emptywheel Discovery is a prosecution issue. I know from experience that both files would have been given to the prosecutors long ago. -
@AllThingsHLS Tho IN THIS CASE, prosecutor is supposed to be a straight shooter. So maybe this is FBI-side.
-
@emptywheel The prosecutor is the guy who stands up & swears that everything has been turned over. It's his Bar card that is on the line -
@AllThingsHLS Admittedly, that's usually blame on CIA. But given the Samir Khan nexus, I wouldn't be surprised if FBI were acting like CIA.
-
@emptywheel The FBI doesn't act that way domestically, particularly where a Federal Judge is involved. Too much potential for sanctions.

@emptywheel Well, let's see how trial plays out. My prediction is still a conviction on the merits; everything else is just dicta. -
@AllThingsHLS Agree. He'll probably be convicted. But FBI's tactics will lose legitimacy in the process. May set up guidelines on kids, too.
