McMahon unaware of "public statements by named, current executive branch officials" on the Aulaqi killing. But Gibbs! http://privacysos.org/node/919

@onekade Also doesn't account for State's apology to Khan's family.

@emptywheel not to mention the fact that Khan and the elder Aulaqi were killed in the same strike. Hard to acknowledge one and not both.

@onekade Remember w/Khan you get into same dubious arguments we surely used w/Kamal Derwish--and the 12/09 strike against Awlaki.

@emptywheel oh that they didn't know he was in the car?

@onekade Or that he was acceptable collateral. Who knows! But we know they really were targeting Awlaki in 12/09 killing.

@emptywheel not intentionality, responsibility. how is admitting they killed Aulaqi not admitting they killed Khan, intentional or not?

@onekade It's not admitting they targeted him. They're maintaining some level of fiction abt whether they knew he was in car.

@emptywheel right but McMahon doesn't mention targeting. She just says "the killings of"

@emptywheel but acknowledging they killed Aulaqi is as good as acknowledging they killed Khan. She even says this on page 12.

@emptywheel "Killed with Al-Awlaki was an individual named Samir Khan." So just because a gov official hasn't said it, Exemption 1 is good?

@emptywheel maybe that's kosher under the statute, but it's totally nuts if so.
