Reading the article, it appears the judge is saying the particular law cited does not define what “select agents and toxins” are, which is hard to understand but whatev. It looks more like the prosecutor chose the wrong statue to press charges.

It is, and that makes it a biological weapon under International Law, but not apparently Federal Law.
