This whole timing crunch is Kennedy’s fault. He shouldn’t have sprung his retirement on everyone.

What time crunch? The court went over a year with 8 justices after McConnell decided not to hold votes on Garland.
-
I agree it’s artificial bullshit, but the GOP want this done and over before the Midterms. That’s reality.
-
True. I'd argue that they still have time to pull Kavanaugh, find someone more amenable, do hearings, and vote in the lame duck session. That feels smarter to me even though I doubt I'd care more for said nominee (except the lack of attempting rape).
-
This is true. And, frankly, the next up may be long term more extremist than Kavanaugh. But Kavanaugh going to make those votes anyway, better to have that "Justice" not have a background in both torture, misogyny and assault.
-
Agreed. The only logic I can see is that Trump isn't willing to pull him because of his views on executive power but I'd think McConnell would know this is a bad look so close to an election.
-
Yeah, think that right. Also, Trump just is incapable of ever conceding a loss. On anything.

If Kennedy bartered his retirement with Trump to put Kavanaugh on the court, then the gloves should come off & Kennedy deserves all the hate that might befall him.
-
This is 100% what happened. Kennedy has a number of shit opinions on his record, and it feels like he wants Kav to defend those decisions. The scariest one to me is Citizens United, which Kennedy wrote....

I'm not familiar w/the other candidates' views on pres. power, but is really the only reason Trump hasn't yanked Kavanaugh yet b/c of his propensity for pres. power? Seat will be filled regardless of timing--seems like a no-brainer to ditch this dude.
-
That is a very fair question. And my bet it is a LOT of it, because McConnell did not want Kavanaugh to start with.
-
Totes. McConnell was even worried about his paper trail--and this was obviously before any allegation was known.
-
Yep, exactly.

I had similar thoughts. He knew what Trump was. He knew the stakes. He chose this path.

Eric Boehlert beat him to the punch
-
Uh, my tweet was from over three days ago. I respect
@EricBoehlert but you sure he was first to the line on this? -
No. I didn’t see your tweet
-
That's cool, no problem. The more the merrier on this point. Anthony Kennedy should have a collar for this.
