@emptywheel, even if the power to pardon includes the power to remit fines and forfeitures... 1) State prosecutors can go after those assets. Many states would allow fed guilty pleas to be admissible in fraud proceedings. 2) Banks can bring tort suits for fraud and restitution. -
Mostly my question is how much leverage does the seizure language in the DC indictment give Mueller; I'm arguing it gives him $30M worth.

depends on timing. my understanding is a pardon that occurred before forfeiture proceedings are completed would stop the process, but a pardon wouldn’t restore to him forfeited property that had already been transferred to someone else.

Hopefully a federal practitioner can chime in, but a pardon erases the conviction as if it never happened. If the money was part of the sentence then in theory he’d keep it. If it is forfeited civilly then the pardon won’t keep him from losing it.
