But DOJ maintains that they can charge conduct that would otherwise be FARA under section 951, meaning they can treat influence operations like Butina's as spying.

One trick is that, unlike Manafort, Butina had to get a visa. DOJ claims she lied on her visa app (about whether she was still working for Torshin). Such claims end up showing a differing level of deception about the operation, supporting section 951.
