The difference bt joining Miller's challenge and being an amicus is that, if and when Miller loses (there's already the Libby precedent here on which he should), he's going to testify. Concord would move to get en banc or appeal to SCOTUS.

So to challenge Mueller's Special Counsel authority, Concord will first have to LOSE its criminal case and then appeal, but this Miller decision -- whatever it is -- will already be waiting at DCC.
