Dunno. They've got full discovery on Gates, which may reveal that Mueller has the goods on the case in chief, or maybe even know something is imminent on that front. So yeah: pardon or indictment?
Do you really think this means they have no defense or they just aren't telling what it is? Which makes sense at this point. I haven't read all the docs though.
I'm less interested in their claim that they may not mount a defense (likely but not surprising) than that they punted on some of the more important things, like jury instruction.

They had asked for an extension, didn't get it, and on a number of issues did the minimum of raising objections w/o getting into specifics. But, NAL.
Same thing as in EDVA, what defense they going to put on?? And expert or two that get carved up by the prosecution? Still can't put Manafort on. They really don't have a substantive defense case to put on even if they wanted to.

if Manafort is counting on a Trump pardon, why not just plead out to the DC charges now to avoid trial, which will surely damage GOP showing in midterms?
Because he doesn't know if he can count on it, it immediately becomes admissible in state courts, and some of the counts would look pretty bad, e.g. the ConFraudUS

Did we ever find out who is paying Manafort's legal fees? Trump? RNC? Other? This 2nd trial is far more complex, and someone has foot the bill for 7 figures in fees thus far.
