By far the funniest example of this is when Erik Prince or his legal pundit Victoria Toensing got people believing he "cooperated" because he complied with a subpoena. That's called "not being cited for contempt," people.

George Papadopoulos, who confused even himself with a plea deal that wasn't not a cooperation deal, is another version of this. https://www.emptywheel.net/2018/08/18/the-ongoing-criminal-exposure-of-muellers-cooperating-witnesses/ … He never proffered enough to get a cooperation deal (prolly bc he was still hiding stuff).

Here's the thing, though: Zero doubt that Rick Gates has been enormously helpful under his substantial plea deal. He's prolly the source of info that led to ~10 cell phones being searched. Prolly reason Mueller has focused on Roger Stone for six months. But!

But you can also make a case with a large number of witnesses who simply small-c cooperate, tell enough truth to match the written documentation, to get at the underlying issues.

The most damaging witness in the Scooter Libby trial was, IMVHO, David Addington. You could have convicted Libby based on Addington's testimony and Libby's notes alone. Was he cooperating against his boos, Dick Cheney? Hell no. But damn he was a useful witness.

If you listen to the daily today
@nytmike says McGahn did more than simply endure questioning but ofc he doesn’t say how and their stories don’t report how -
And, as a lawyer, you opinion about that is ...?
-
Maybe someone can clear this up for me... how does a publication routinely do articles on rich white males & completely ignore their history? In the Trump & Mcgahn story, isn't it important to know they have history back to the 80s?https://twitter.com/craigunger/status/1031309209474883584?s=19 …

NYT Schmidt said on Morning Joe that McGahn didn't ask for immunity. Was afraid if he didn't show everything he had to Mueller, he'd be on the hook w/ Mueller or scapegoated by Trump. Very self-serving version for McGahn. What is 'everything', exactly?
-
Yeah. That's still not big-C cooperation, meaning Mike misled the country with shitty reporting. It's staying out of legal jeopardy c-cooperation.
-
I'm guessing this stunt is bc Trump is ready to fire him but McGahn wants to keep the job.
-
McGahn doesn't want to go to jail or lose his license. If he was serious, he'd have offered a proffer to Mueller. This is about as serious as Pence being angry at Flynn for lying to him...and being "the" reason Flynn was fired.
-
Agreed. I mean spinning it publicly as McGahn distrusts Trump/'cooperated' in unknown ways is very peculiar. Seems to me that it would make any firing of McGahn look like retaliation...

Yes,correct- cooperation implies that both sides have power, not true in this case at all.

Waterboarded prisoners also 'cooperate' sometimes.

I laughed at the angry look on M Schmidt’s face this morning when a legal analyst went through this. He thinks very highly of his work, it seemed at that moment.

McGahn's a gov't employee essentially, he had no choice, but to come in when summoned by Mueller. Neither DT or Guiliaini could stop his cooperation, anymore than they'd control what he said. Atty/client privilege doesn't exist so DT did us no favors. Same w/docs, they had to..
-
Not exctly McG is WH Couns Per se,the Exec could claim exec privilege over certain matters Not merely would that result in info not been given The painful pace of it,would b so grievously inefficient,as 2frustrate the investig POTUS instructed his WHCounsel to speak freely

-
McGahn represents the people & the ofdice of prez. Nothjng he does is FOR DT but rather FOR the ppl. DT can't ask for ex priv is my understanding

-
Well he can, on certain matters - as the WH Counsel needs to be free to give advice to POTUS That type of advice effectively becomes a State Secret :) Now the issue we both know is McGahn was party to foetid streams from Don Pottymouth ... they're... different
