Yes, Kagan had no judicial record to review and I complained about that at the time. But you go through confirmation with the nominee you pick, not with the one who shouldn't be confirmed in the narrow window before impeachment starts.

Lots of nominees (albeit to lower courts) have been confirmed with impeachment proceedings looming. There's no norm or tradition of suspending confirmation process because of investigations of Presidents.

If Kavanaugh is confirmed and Democrats take the House the FIRST subpoenas they issue should be for the Kavanaugh documents. If they show he committed perjury he should be impeached from the Court.
