While I do agree with you that this is a good thing, I imagine that they'll find security & privacy failure is the norm, and extremely rare any exception.

Legal changes will be needed if they're to do much without consent of their target Even with consent, 3rd party ip etc could be problematic Some primary statute to allow red teaming, require red teamers to register every Operation with a Federal body - would be good

Not sure I'm following this. Why would legal changes be needed? Consumer Reports on other areas of product flaws & failures didn't need this, so why would security & privacy failures of digital products be any different?

Well they say <Ratings are based on analyses of operations and data policies> Maybe I am misreading, but I assume analyses of operations, includes things like penetration testing ? Or are their ratings predicated on just the operating manual, policies etc ?

I agree that they'd have to do penetration testing (i.e. White/Black Hat hacking) if they were to actually rate digital product security & privacy, but I'm not sure why that would necessitate new laws. Of course, if it is the case that all hacking is by definition illegal...

Yes, the TOS alone tend to be quite restrictive, ditto laws around IP & hacking A lot of civil & criminal liability can result from reverse engineering , penetration testing etc & then the 3rd party elements, e.g. App testing - would break IoS or Android TOS
