      People seem not to understand this. Espionage Act is used to charge primarily leakers. Occasionally, it is used to charge people leaking for other countries. Agent of foreign power--what Butina was charged with--is what we call other countries' spies. It's different than FARA.

      But other parts of the "Espionage Act" are used to charge leakers. 18 USC 793: what they charged Sterling, Manning, Kim with, and wanted to charge Hillary with So we insist on calling leakers spies and spies (and sleazy influence peddlers) agents.

      This is ... dumb! Maybe call leakers leakers and not spies, and call spies spies? But trust me, Butina was charged with what we charge foreign spies (such as Yevgeny Buryakov, the spy who thought Carter Page would make a nice asset).

          The reason most spies are charged under the sections you refer to as for leakers is that it simplifies the case for the government. That is, there’s no need to prove Wikileaks is a creature of Russian intelligence to put Manning in jail. 1/

          That's not what I said. I said most people charged under Espionage Act aren't spies. I don't consider Manning to be a spy, at all, and USG lost their bid to claim she had aided the enemy.
