People seem not to understand this. Espionage Act is used to charge primarily leakers. Occasionally, it is used to charge people leaking for other countries. Agent of foreign power--what Butina was charged with--is what we call other countries' spies. It's different than FARA.

22 USC §611: Manafort's kind of Agent of a Foreign Power (you have to register with State) 18 USC § 951: Butina's kind of Agent of a Foreign Power (you have to register w/AG)

One part of "Espionage Act" (which is what you'd think we'd call the law exclusively used w/so-called spies), 18 USC §794, prohibits providing "defense information" to aid foreign govt. Kevin Patrick Mallory recently convicted or giving info to China. https://www.courtlistener.com/recap/gov.uscourts.vaed.368225.34.0.pdf …

But other parts of the "Espionage Act" are used to charge leakers. 18 USC 793: what they charged Sterling, Manning, Kim with, and wanted to charge Hillary with So we insist on calling leakers spies and spies (and sleazy influence peddlers) agents.

This is ... dumb! Maybe call leakers leakers and not spies, and call spies spies? But trust me, Butina was charged with what we charge foreign spies (such as Yevgeny Buryakov, the spy who thought Carter Page would make a nice asset).

If you're David Petraeus, & you give your mistress code word information to get laid, but you know Where The Bodies Are Buried, you get charged w/18 USC §1924, Unauthorized Removal of Classified Information. There's a lot of words I could think of to call this but I'll refrain.

Also if you're the President or Vice President and you release a CIA officer's identity or scream details about a key ally's deeply embedded asset on Fifth Avenue, you get to tell everyone to fuck off.
