Why would the DOJ RAISE the bar in this indictment for themselves? They could have left it OR but instead changed it to AND meaning both counts are coming...seems to me they would need to have evidence to support that kind of bluff...as far as I can tell the FBI does not miss.

Marcy I'm new to this universe. Do leakers of this magnitude typically get plea deals? Would the govt be avoiding trial or do they think he is involved in something bigger? Some things I read (and read into) on him suggested the latter to me.

Hard to tell. They have to be furious about him, but also might want to use him against WikiLeaks. Undoubtedly, they want to avoid a trial, though, for fear of exacerbating the damage of the leak.

Don't read too far into that. Indictments are supposed to be worded in the conjunctive. E.g., United States v. McGinnis, 783 F.2d 755 (1986)
