Some people saying CJ Roberts “exempted” nat-sec surveillance from Carpenter opinion. Don’t think that’s right. He says he’s not addressing nat-sec surveillance, but his arguments about when surveillance constitutes a search would apply with same force in the nat-sec context.

It seems @JakeLaperruque's suggestion--this is about 702--is on point. No warrants there, definitely searches, but because you were just wildly speculating per Sammy still constitutional.
