The @DNC's argument could be replicated by @TheJusticeDept to target an outlet like @theintercept . "If this precedent is out there, the govt would happily describe the Intercept as a co-conspirator," in the Winners or Albury leaks, @emptywheel told CPJ. https://cpj.org/blog/2018/05/by-suing-wikileaks-dnc-could-endanger-principles-o.php …

Not sure that's a fair reading of the complaint. Alleged facts point to a more active role for Wikileaks. WL didn't just receive stolen materials; they encouraged them to be stolen in the first place and collaborated with Russian handlers to max. impact to Trump campaignpic.twitter.com/hZvZC9rTFT

That second one isn't different from Panama Papers, which very few people complain about. Which is part of my point: description of WL's actions is journalism. I think we may well get proof of more, but it's not in the complaint.

"Encouraging continued illegal hacking" is a pretty serious charge, and not one you could apply to any media organization. It's also just a complaint; the more telling reason this likely won't set bad precedent is that DNC didn't sue mainstream media outlets.

Yeah, but there's no evidence to that claim. And forgive me if I find pat notions of who does and does not count as "mainstream media" entitled to the privileges of being treated as media obnoxious.

      1. If you're reading the tea leaves from the complaint, it's not fair to disregard alleged facts and then conclude that lawyers in the future will make similar allegations without a Rule 11 basis. Also, there is *some* evidence to support the claim.

      2. Assange disregarded ordinary WL procedures (WL normally anonymizes their data intake so that WL itself can't be certain of source's identity) and actively sought stolen emails from Guccifer. Assange also lied about source of emails later, blaming Seth Rich.

I think the case supporting both those claims is not airtight at all. And I think Russia built in far more plausible deniability than is yet public.

It's a complaint; the evidence wouldn't be expected to be airtight at this stage. But enough is alleged that it's not fair to draw a conclusion that DNC's allegations could set a bad precedent for journalism.

Again, in the areas specifically talking about WL conduct, they describe activities that are solidly journalistic activities. They lose that I have less of a problem. It's a complaint. I imagine a placeholder. Hopefully they'll fix these problems going forward.
