this whole argument about "winning in court" is absurd because trump will not end up in court. doj's position is that sitting president cannot be indicted and mueller is bound by that policy.

Oh. 1) SOL even on some of Trump's known actions (say, 12/29/16 deferral of sanctions) runs out 5 years later, so in that case 12/29/21. 2) Trump's testimony will affect aides (POTUS and VPOTUS was crucial, eg, in Libby case), who will end up in court.

My only guess is McGahn knows indictments of Ivanka, Jared and Don Jr are immanent and recruited him at the behest of the Pence camp to handle whatever happens when Trump explodes. He's not there for Trump. Or they know Pence is going too and it's going to get even more complex

Agree Flood came on for some larger, endgame purpose. I thought it might be to replace McGahn, who may anticipate that he'll be embroiled, or simply wants out. But Marcy's point is that Flood came in knowing he'd be rolling in the mud pits, rather than fighting in court.+

I believe he came in after the Cohen raid. That will probably in hindsight be seen as the moment many realized it was over. McGahn picked up from Trump's reaction that the whole family was done. Flood won't do spin, he'll negotiate transition of power. Historic or ...
