He put hands on them first, that makes him the aggressor in the scenario, therefore he cannot, by New Mexico law - use any action that falls under self-defense. Sounds like a brutal law that you forfeit yourself for an ass-kicking if you start it, but law's the law.

He was pepper spraying random people and threw a girl trying to stop him. He was a danger to everyone around him the minute he got dropped off.

He assaulted a female protestor, she fell on the ground, still no info on what he did to her or what weapon he used. The protestors started chasing him out when he shot at them. Under NM law they had an obligation to make a civil arrest.
