      Here’s my read on the Jeffrey Clark situation, as just discussed with @ErinBurnett @OutFrontCNN: Clark’s lawyer sent in a last-minute letter invoking a whole range of privileges - most of them bogus and inapplicable - but also, for the first time, mentioning the Fifth Amendment.

      Any person absolutely has the right to take the Fifth if his testimony might be used against him in a criminal prosecution. That applies to testimony in criminal cases, civil cases, or Congress. People can and have taken the Fifth in Congress.

      Clark does have a legitimate Fifth Amendment concern here - that’s his right. I’ve written and spoken on air before about crimes Clark potentially / apparently committed - election interference, conspiracy, fraud.

      So while it is Clark’s right to take the Fifth, at the same time, it’s an utter disgrace that a former high-ranking DOJ official would have to resort to the Fifth, which is at least an implicit acknowledgement of his own potential criminality.

      The Committee has decided they’re not going to settle for a vague invocation of the Fifth in a letter from Clark’s lawyer. They’re going to make Clark come in and physically invoke it, maybe many times over. They’re going to make Clark own it and eat it.

          If Clark does come in and take the Fifth now, he very likely won’t be charged with criminal contempt. Sure, the Committee might argue “Too late, he didn’t take the Fifth back when he first appeared.” That’s true but also quite technical and DOJ likely won’t charge based on that.

          But Clark’s invocation of the Fifth is a political win for the Committee. They already have at least the damning public information on what Clark did (including the fraudulent letter to Georgia).

          And now whenever anyone tries to downplay January 6, it’s fair game to remind them that Clark, a very high ranking former DOJ official and Trump confidante and enabler, had to cover up and take the Fifth because he knows he has potential criminal liability. (end)

          One more thing, responding to some comments. Clark *can* still be charged for whatever he’s taking the Fifth on - election interference, fraud, etc. - if the proof is there. But a person who takes the Fifth can not (likely will not) be charged with criminal contempt, however.

          A preview of Saturday: Rather than prosecuting Jeffrey Clark now the @January6thCmte is giving him the chance - MONTHS later - to have a "do over" & come in & plead the 5th to avoid contempt prosecution *AND* they will let him do it behind closed doors so no public embarrassment
