Prosecuting someone for spreading smallpox, when smallpox was in circulation, was a non-starter for technical reasons. It's way too hard to prove who gave it to whom. If it were easier to trace, you'd have a clear bodily injury tort.

In an era of biosurveillance...that could change fast. Note that this is separate from whether it's a felony or a criminal offense at all. And all of this is separate from the question of reintroducing smallpox to the world -- which warrants summary execution.

If a lone individual releases a novel disease that affects the geopolitical balance in a meaningful way, I think they'll have bigger problems than the legal system. That seems like a one-way ticket to an extrajudicial assassination.

honestly depending on how they released it, yes. dhs has a whole ass bioterrorism watch program so if you tried to release it aum shinryko style it would probably get picked up on real quick
