From what i recall, what happened is that people deliberately undervalued the property stolen ("eg. 5 pound note; value half a shilling" ) , as they felt the punishment was too harsh...

This seems to be a general theme through legal systems; whenever there is an excessively harsh punishment, you see a trend towards people re-defining the offence so it does not get caught.

there's also a marginal incentive problem if you're gonna be killed anyway if you get caught robbing a store, best not leave any witnesses
