My immediate, intuitive feeling is that the latter is an ethical system and the former a legal system and that we probably need both

I see the former as a concession to human group dynamics while the latter is "real". Almost everybody would prefer to live around virtuous people rather than those who simply followed prescribed guidelines, but it's hard to build a court system on that.

Ethical systems that say the things people are going to do anyway are bad, but for a nominal price, you can be good again, seem to have the most legs.

100%, but I would add that 'good things' can be a distraction. It's not the thing that's good or bad, it's the doing.
