Maybe there’s analogs to premises liability? Like if you come to my business and slip and fall, I may be liable... but I’m struggling to see how that doesn’t run afoul of 1A, cuz the thing you’re slipping on is speech not a banana.

like publishers and editors can be held liable for the speech of others under the theory that their speech becomes your speech through some *active* commingling on your part, and whatever speech it is is not protected (threats, libel, etc) but absent that active part? prob not

Kill §230 and replace it w a federal anti-SLAPP. The latter will provide substantial protections against frivolous suits. The former will mean that Zuck & co can’t just shrug in the face of genuinely libelous content. Will likely kill some Social Media, but we’d be better for it

oooooooof idk, this directly depends on how much harm you think speech on social media actually causes. I’d love federal anti-SLAPP, but I want Zuck to shrug harder, not less.
