I think it's got to be a pragmatic yes too. I also can't imagine a one-size-fits-all general policy solution here. Everything is going to have to be case-by-case anyway, so it seems insane to do anything besides use the existing case inquiry mechanism in our legal system.

How does this overcome: undergrad, masters, PHd (all at full freight fully debt), then immediate declaration of bankruptcy at graduation (throw in $20k of credit card debt for good measure)? In many ways I’m sympathetic to bankruptcy option, but the above nukes it

this is exactly the kind of reason the process needs to happen on a case-by-case basis in a court. A judge would be able to examine a case like that, make a judgment on whether it was an attempt at fraudulent exploitation or if there were legit extenuating circumstances.

Your honor, it is my life’s passion to play concert flute, which requires a PhD to get into an orchestra. All my professors said this was a viable career. I literally have no other skills because I’ve devoted my life to this pursuit. Then COVID happened and orchestras dissolved.
