You're right and it's fascinating that despite having 100s of years of globalized capitalism under our belts that lawmakers around the world keep falling for this sort of anticompetitive regulatory capture scheme.
Intense legal hurdles are probably one of the worst forms of regulation for monopoly development because by effectively imposing a flat dollar-amount barrier to entry and operation you've effectively instituted a regressive tax on businesses in that market.
Part of it is that when talking with normies or anticapitalist ideologues, when you talk about this, all they hear is bootlicking for the big boys. "Anticompetitive means FAANG profits less, boo-boo." No, anticompetitive means FAANG stay on top, forever.
Part of me feels that any possible solution would require some form of education in this to the people who write and pass regulatory law, but I'm not sure how that would be done. AOC has an economics degree and still introduced the Green New Deal.
