there are some options: exile, execution, or home-detention.

home-detention is especially interesting to me because it forces the state to reckon with how uneconomical it is to implement on a mass scale, meaning it would probably not ever be used for small crimes. would force more creative sentencing for most crimes.

what if the typical sentence for a felony was restitution rather than incarceration?

Unless you plan to put said felon into some form of physically enforced servitude I think I see a problem with this approach. If you do, I think I see a different problem with this approach.

garnishing wages? that's already done in the current system. home-detention would have to involve an income earning exception, like monitored commuting between home and workplace. in the current system prison labor already exists too, so it's not like this is new.

Does your typical felon make enough money that you can garnish any meaningful amount of it?

doesn't matter, really. they'll pay what they can. restitution here is still punitive, it's meant as an alternative to incarceration (or exile or death if we're talking about a prisonless system). restoration of victims is a separate concern

then they are in debt, and if they default on their debt payments they'll have to face escalation of their punishment, such as being put in home-detention
