Generally speaking defiance of a court order is punishable by contempt, which can be civil or criminal. Criminal, judge could make a referral to the US Attorney; civil... yeah, court’s right, it’s moot. Civil contempt generally has to be to produce compliance, not punish.

Judges have always had problems with enforcing orders on institutions. The same way that no one person can fix a problem by themselves alone, it's hard to identify any one person of being actionable noncompliant without holding them accountable for the actions of others.
This isn't anything new, either. There's a hospital in my hometown that gets threatened with action 2-3 times a year but nothing ever happens because no one person is causing the illegal situation so the same charade happens over and over.
